These Terms of Service apply to the TryOns Discord bot, including its text-to-speech, voice cloning, uploaded voice, generated audio, and Discord voice-channel features.

This document is written for users, server owners, and server administrators. It is not a substitute for independent legal advice.

1. Acceptance of these Terms

By inviting, accessing, configuring, or using the TryOns Discord bot, you agree to these Terms. If you do not agree, do not use the bot and remove it from your Discord server.

If you add the bot to a Discord server, you confirm that you have permission to do so and that you are responsible for making sure the server's use of the bot complies with these Terms, Discord's rules, and applicable law.

2. What the bot does

The bot provides text-to-speech, voice cloning, voice upload, and generated audio features for Discord. The bot may join Discord voice channels and play AI-generated audio in those channels when requested by users.

The bot is intended for entertainment, community engagement, and creator/community use where all required rights and permissions have been obtained.

3. Discord rules and third-party rules still apply

You must comply with Discord's Terms of Service, Community Guidelines, Developer policies, and any applicable server rules.

You must also comply with the terms and acceptable-use rules of any third-party services used by the bot, including ElevenLabs where applicable.

If there is a conflict between these Terms and Discord's rules, Discord's rules take priority for activity on Discord.

4. Eligibility

You may only use the bot if you meet Discord's minimum age requirements for your country or region.

You must not use the bot if you are prohibited from doing so by law, Discord, these Terms, or any relevant third-party provider terms.

5. Voice cloning and consent

Voice data can identify a real person. Misusing voice cloning can cause serious harm.

You may only upload, clone, use, or generate audio from a voice if you have the legal right to do so.

You must not upload, clone, or use another person's voice unless you have clear, explicit, and provable permission from that person or another lawful right to use that voice.

By uploading or using a voice, you confirm that:

• the voice is your own voice, or you have explicit permission from the voice owner;
• your use of the voice is lawful;
• your use will not mislead others into believing generated audio is a real recording;
• your use will not harm, harass, exploit, impersonate, defame, or deceive anyone;
• you will provide proof of permission if we reasonably ask for it.

The bot currently relies on user confirmation for voice ownership and permission. Voice clones are not manually reviewed before every use. Because of that, users are fully responsible for the voices they upload and use.

We may disable, delete, restrict, or investigate any voice if we believe it was uploaded without permission or is being used abusively.

6. No impersonation or deception

You must not use the bot to make people believe AI-generated audio is a real recording of a person.

You must not use the bot to:

• impersonate streamers, creators, public figures, politicians, celebrities, private individuals, companies, organisations, moderators, Discord staff, law enforcement, emergency services, or government bodies;
• create fake evidence, fake confessions, fake threats, fake endorsements, fake private conversations, fake instructions, or fake announcements;
• make another person appear to say something they did not say;
• deceive people into sending money, sharing personal data, revealing credentials, joining servers, buying products, or taking any other action;
• bypass voice authentication, voice verification, account security, identity checks, or similar systems;
• hide or deny that audio was AI-generated where that would be misleading.

AI-generated audio from the bot must be treated as synthetic content. It is not proof that a real person said anything.

7. Prohibited uses

You must not use the bot to create, upload, request, generate, play, distribute, or encourage content or activity that:

• is illegal or would create criminal, civil, regulatory, or platform liability for you, us, Discord, or any third party;
• involves fraud, scams, phishing, social engineering, blackmail, extortion, account theft, malware, hacking, or credential theft;
• harasses, threatens, humiliates, doxxes, bullies, abuses, or targets another person;
• creates or distributes non-consensual sexual, intimate, or humiliating content involving a real person;
• involves sexual content concerning minors or any child sexual abuse material;
• promotes hate, discrimination, or violence against protected groups;
• promotes terrorism, violent extremism, self-harm, suicide, or real-world violence;
• impersonates or simulates political candidates, political parties, elected officials, public officials, law enforcement, emergency services, courts, regulators, banks, employers, schools, or medical professionals;
• manipulates elections, civic processes, legal proceedings, employment decisions, financial decisions, markets, emergency responses, or public safety;
• violates intellectual property, privacy, publicity, personality, data protection, contractual, or confidentiality rights;
• spams, raids, mass-mentions, disrupts servers, or interferes with Discord or other services;
• attempts to evade moderation, enforcement, technical restrictions, provider safeguards, or rate limits.

8. User content and responsibility

You are responsible for all text, prompts, commands, voice samples, audio, files, and other content you submit to or generate through the bot.

You confirm that you have all rights, licences, consents, and permissions needed for your content and your use of the bot.

You must not submit private, confidential, sensitive, or regulated information unless you are legally allowed to do so and accept the risks of processing it through the bot and third-party providers.

9. Generated audio

Generated audio may sound realistic, but it is synthetic. You must not present generated audio as a real recording of a person.

Using the bot does not give you ownership of someone else's voice, likeness, identity, performance, personality rights, or other rights.

You may only use, publish, sell, share, or commercially exploit generated audio if you have all required rights and permissions.

10. Moderation and enforcement

We may block, remove, disable, restrict, suspend, or terminate access to the bot, a voice, a user, or a Discord server if we believe there is misuse, legal risk, safety risk, impersonation risk, platform-policy risk, provider-policy risk, or violation of these Terms.

We may take action without prior notice where necessary to protect users, third parties, Discord, service providers, or Tryons.

We may report serious misuse to Discord, relevant service providers, rights holders, regulators, or law enforcement where appropriate.

11. Abuse reports and takedowns

To report abuse, unauthorized voice cloning, impersonation, fraud, harassment, or other misuse, email david@tryons.net.

Where possible, include:

• the Discord server name or ID;
• the Discord user ID or username involved;
• the approximate date and time;
• the command or generated audio involved, if available;
• why you believe the voice or content was unauthorized, deceptive, illegal, or harmful.

If someone credibly claims that their voice has been cloned or used without permission, we may disable the relevant voice or feature while we review the report.

13. Paid features

The bot is currently free. Paid or premium features may be introduced in the future.

If paid features are introduced, additional payment terms, refund terms, and subscription terms may apply. Unless stated otherwise at the time of purchase, refunds will only be provided where required by law.

14. Availability and changes

The bot is provided on an "as is" and "as available" basis.

We may update, change, suspend, limit, or discontinue the bot or any feature at any time. We may also change supported commands, supported voices, usage limits, moderation rules, access permissions, providers, or pricing.

15. No warranties

We do not guarantee that the bot will be uninterrupted, error-free, secure, accurate, lawful for your intended use, or suitable for any particular purpose.

We do not guarantee that generated audio will be realistic, appropriate, available, or free from third-party rights claims.

16. Limitation of liability

To the maximum extent permitted by law, TRYONS LOGISTICS LTD will not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages, including loss of profits, data, goodwill, reputation, business opportunity, or server activity.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

17. Indemnity

You agree to indemnify and hold TRYONS LOGISTICS LTD, its directors, employees, contractors, and service providers harmless from claims, losses, liabilities, damages, costs, and expenses arising from your content, your use of the bot, your misuse of voice cloning, your violation of these Terms, or your violation of law or third-party rights.

18. Termination

You may stop using the bot at any time by removing it from your server or stopping interaction with it.

We may suspend or terminate access to the bot at any time if we believe these Terms have been violated or if continued access creates risk for users, third parties, Discord, service providers, or Tryons.

19. Governing law

These Terms are governed by the laws of England and Wales.

The courts of England and Wales will have jurisdiction, unless mandatory law gives you additional rights or requires a different forum.
